The discrimination against same-sex couples has played an important part in legislation, politics and media for many years. This thesis is dedicated to reveal the discrimination of same-sex union in the Austrian law, to illustrate the judgments of the courts and to express the legal changes.First of all, the progress of the Austrian law of same-sex union allowing for the Civil Partnership Act will be demonstrated. The main part of this thesis deals with the single discrimination facts including the judgements of the Constitutional Court and the European Court of Human Rights. In addition to that, the inevitable legislative amendments will be presented. Finally, the law possibilities, which are necessary for the entire equality between opposite-sex couples and same-sex couples, will be analysed.
