This thesis focuses on stepchild adoption. Stepchild adoption is a special type of adoption through a single person. With this kind of adoption, the marital, the registered or the domestic partner adopts the child of the other partner.When it comes to domestic partners and registered partners, only the biological child may be seen as their child, whereas for marital partners the biological child as well as an adopted child is eligible for stepchild adoption.The purpose of the stepchild adoption is to create an environment closely resembling a family. Because of this, the not displaced biological parent in a stepchild adoption cannot revoke his rights under family law. This differs from the adoption of unrelated children. In its first chapter this thesis deals with the historical development of adoption, which starts with the codification of the "ABGB" in 1812.The second chapter portrays the current legal situation in accordance with the "Adoptionsrechts-Änderungsgesetz 2013". Additionally the stepchild adoption, successive adoption and parental rights are discussed in this chapter. Furthermore, this thesis expands on the impact of stepchild adoption, its realization and the effects of divorce or separation of the birth parent and the adoptive parent. At the end of the thesis, adoption of unrelated children through homosexuals will be discussed.Especially the acceptance of judicial judgments of foreign adoption decisions will be highlighted, which might present to be even more problematic when it concerns homosexual partners.The conclusion of the thesis is a short digression dealing with the reproductive medicine act.
