A rule, which consists since the primeval times of European ruling, namely Art 157 TFEU, should be analysed in the present paper. In order to understand the progress of the rule, it is important to discuss the history of the norm concerning equal payment of equal work and work of equal value. Thus, the first chapter is about Art 119 European Community Treaty old version and Art 141 European Community Treaty. The next chapter represents the main part of the paper: After having analysed the historical outline of the rule, the single elements of Art 157 TFEU are made subject of the discussion. It is essential to regard the dispensation of justice of the European Court because of the limited wording of the article. So, various judgements have to be discussed in each chapter. Owing to the progress of Art 157 TFEU due to the judgements of the European Court, an isolated analysis without any references to actions of the Court would not be helpful. Furthermore, the presentation of various judgments helps to make the dry subject more interesting. The discussion of a few Austrian cases concerning the payment of equal work and work of equal value is the second part of this chapter. Finally, the concrete situation concerning differences in payment in Austria should be analysed and also an overview of Austrian norm should be given.
