In this diploma thesis the difficulty of solitary confinement shall be examined carefully. The focus is on the international and regional legal framework and its enforcement mechanism. Furthermore the monitoring bodies and its procedures as well as material provisions shall be analyzed in this paper. This diploma thesis shall pose the question which provisions and mechanisms are binding and viable. The diploma thesis is structured in the following way: Chapter One addresses issues of definition, provides the types of solitary confinement and the decisions of placement in solitary confinement. Furthermore it approaches the procedures and safeguards of the treatment of prisoners. Chapter Two examines the proven health effects of prisoners in segregation, both physical and psychological, and tries to understand what makes solitary confinement damaging. Chapter Three sets out the international legal and regulatory framework as well as the monitoring bodies and procedures. Chapter Four analyzes the regional legal and regulatory framework just as the monitoring bodies and procedures. This chapter is focused on Europe. Chapter Five examines solitary confinement in Austria. The last chapter, Chapter Six recaps some of the main issues and themes discussed throughout the diploma thesis.
