This diploma thesis concentrates on the elaboration of the Austrian tort law since 1811. In the first section a historical overview of the Austrians? tort law development is given and furthermore, the Austrian Civil Code, which is valid since more than 200 years, is appreciated. The diploma thesis focuses on the reforms of the tort law. Within the discussion of the Third Partial Amendment (1916) to the Austrian Civil Code, particular provisions are discussed in detail. The exact processing of the strict liability development in the Austrian legislation is essential, because it constitutes a crucial part of the Austrian tort law. Based on concrete special provisions the development is discussed in detail. The last part of the diploma thesis represents problematic issues of the tort law as well as its reform efforts. The diploma thesis concludes with a personal résumé.
