On the 24th of June 2016, the Council of the EU has adopted the Regulation in matters of matrimonial property regimes and the Regulation in matters of the property consequences of registered partnerships in pursuence of the enhanced cooperation between certain members of the European Union. Finally the jurisdiction, applicable law and the recognition and enforcement of decisions in the mentioned matters has come to an european legal regulation. The present diploma presents the terms regarding the recognition and enforcement of decisions in matters of the property consequences. In the beginning, the scope of these latest regulations regarding the european civil procedure law is illustrated. Subsequently, the reader learns about the recognition and enforcement of decisions, which is the core of this diploma. Regarding this topic, the process of the recognition, the possibility of staying of proceedings and the reasons, why a recognition could be dismissed are ventilated restraint of the so called revision au fond. The next chapter deals with the process of the declaration of enforceability of a decision. Intraductory, the proceedings at first instance are elucidated, including the requirements for a positive decision regarding the declaration of enforceability. Then, the diploma illustrates the possibilities of legal protection of the obligee and the debtor, followed by an explanation which reasons the debtor can allege against fight the specific decision. After that, the charactaristics of the proceedings in third instance are explained. The diploma also informs about the case, when there is legal action against the decision of one memberstate, while there is a proceeding regarding the declaration of enforceability in another memberstate. In the end, there is a final review about the topic and a short summary about some critical points reagarding the regulations.
