The Austrian school system, and particularly the responsibilities of federal and state governments in this regard are a constant hot topic in Austria. The aim of this diploma thesis is to describe the responsibilities of federal and state governments in article 14 of the Federal Constitution for the general educational system and in article 14a of the Federal Constitution for the agricultural and forestry educational system and find out what their boundaries are. The second chapter includes a historical description on the development of competences in the Austrian school system. The third chapter discusses the constitutional basis of article 14 and 14a of the Federal Constitution. Then the main chapter, which describes Article 14 of the Federal Constitution, follows. The individual areas of competences and their limits are displayed in the fourth chapter, so that we can filter out the distribution of competences between the state and the countries in detail. Also the laws, which result from the competences, are described. The specifics of Article 14 of the Federal Constitution are also shown in more detail: the several definitions of the Federal Constitution, the right of supervision of the federal government, the reference to the general distribution of competences and the specifics of the resolution system in Article 14 of the Federal Constitution.The fifth chapter includes the same construction as chapter four and Article 14a of the Federal Constitution and its special features (the right of consent of the countries, the reference to certain regulations of Article 14 of the Federal Constitution, the right of supervision of the federal government) are described in this chapter.In chapter six the two articles are compared. The construction of the two articles, their correlations and differences, their special features and the intervention by the federal government are discussed. In a final prospect the reform attempts in the educational system are shown.
