The aim of this thesis is to describe the development of the delict under § 274 of the Austrian Criminal Code. Since the introduction to the Austrian Criminal Code in 1975 this delict has not been used very often. Over the last years, it has become more common, thus leading to more legal proceedings and convictions based on it. Due to criticism, the delict was reformed in the 2015 Criminal Law Amendment Act. At the beginning of 2016, the new version of the delict entered into force.In the current § 274 of the Austrian Criminal Code, the scienter attendance to a gathering of numerous people with the purpose of committing an act of violence is punishable. However, a punishment according to the delict is only possible, if an act of violence was actually committed. This thesis focuses on the developments of the past years in addition to § 274 of the Austrian Criminal Code. First, it will discuss the delict before the improvement and describe particular cases. Afterwards, the critique of the delict and the reform process are explained in detail. Finally, the new version of § 274 of the Austrian Criminal Code is examined with the aim of determining whether the improvements have changed the situation according to the criticism.
