First in this thesis, the definition of holiday law as well as the inherent principles of the term will be discussed. Consequently, a historical overview of the legal development of vacation in the current sense will be given. This includes the holiday in the Roman army, the Middle Ages, the monarchy, the First Republic, the time oft the NS regime as well as the 1976 creation of the UrlG and his development until now. Second, this thesis will deal with the current legal situation regarding the extent of holiday demand, the arrangement of holiday as well as the possibility of a company leave. Those aspects will be critically analyzed and discussed in terms of German court ruling. Thus, existing errors of Austrian holiday law will be shown and recommendations for improvement will be given. To conclude, the thesis should give an overview of the development of holiday law in the current sense as well as the current existing legal arrangement errors.
